Brewster Land Company, LLC is challenging Dorrance Township’s zoning ordinance, arguing that the version in effect before a September amendment unlawfully excluded data centers as a permitted land use under Pennsylvania law. The company filed a substantive validity challenge with the zoning hearing board but has not yet submitted a formal application to build its proposed six-building data center on a 155-acre, commercially zoned parcel. October testimony focused on whether data centers were permitted or could be considered a conditional use under prior ordinance language, with township officials stating they were not expressly allowed. The hearing is bifurcated, and if the board rejects the challenge, the company may appeal to county court. As of August, the developer has appealed the Zoning Hearing Board's rejection for being exclusionary.
