Authors Sue Salesforce Over Pirated Books Used to Train Its xGen AI

Novelists Molly Tanzer and Jennifer Gilmore filed a proposed class action saying Salesforce trained its xGen language models on the Books3 trove of pirated books.

On 15 October 2025 novelists Molly Tanzer and Jennifer Gilmore filed a proposed class action in San Francisco federal court accusing Salesforce of using thousands of books without permission to train its xGen AI models^[1][5].
The complaint says Salesforce 'pirated hundreds of thousands of copyrighted books' by training on the RedPajama and The Pile datasets, which contain the Books3 corpus, starting with the CodeGen models in March 2022 and running through XGen and xGen-Sales (October 2024)^[5].
It quotes Marc Benioff saying in January 2024 that AI companies' 'training data has been stolen' and that creators should be paid, and asks for statutory and actual damages for a class period from at least 15 October 2022^[5].
Their lawyer, Joseph Saveri, said it is important that companies using copyrighted material for AI products 'are transparent' and that his clients be 'fairly compensated'; Salesforce declined to comment^[1].
A related authors' suit was consolidated with it before Judge Charles R. Breyer, and Salesforce answered the amended complaint in February 2026^[2].
