New Jersey has introduced multiple data center bills. S4318 (Sen. Burzichelli, Sen. Greenstein) requires the BPU to study data center effects on electricity costs and was signed into law by Gov. Murphy. S4293 (Sen. Ruiz, Sen. Burgess) requires data centers to report water and energy usage to the BPU; conditionally vetoed by Gov. Murphy in October 2025. A5462/S4307 (Asm. Dave Bailey Jr.) would require electric utilities to develop special tariff rules for data centers using 100+ MW monthly to protect non-data-center customers from cost increases; pocket-vetoed by Gov. Murphy as one of his last acts and refiled in the 2026 session. In February 2026, committees in both chambers approved a bill requiring large power users (100+ MW/month) to pay at least 85% of their service costs.
