Dutch Court Bars Lidl From Selling Birkenstock Lookalike Sandals
- The District Court of Gelderland, sitting in Arnhem, ruled for Birkenstock in its copyright case over Lidl's lookalikes of the Arizona, Madrid, Gizeh, Boston and Florida sandals, holding that all the Lidl sandals at issue infringe the copyright in Birkenstock's footbed design[1]
- Lidl must stop offering them in the Netherlands on pain of EUR 5,000 a day, declare its sales and orders, compensate Birkenstock and pay its legal costs, with the sums set in separate proceedings[1]
- It is the second Dutch ruling to depart from Germany's Federal Court of Justice (BGH), which denied Birkenstock sandals copyright protection in 2025; the District Court of Midden-Nederland ordered Scapino to stop selling lookalikes on 12 November 2025 (under appeal)[1]
- On 4 December 2025 the EU Court of Justice held in Mio and konektra that industrial designs can qualify for copyright if they reflect their author's free and creative choices[1]
